The MP-MLA special court acquitted six people, including the SP leader, of the charges after the prosecution could not produce evidence to prove their involvement in forcibly evacuation of people and looting of their belongings.
"Like other SP leaders, including Mohammad Azam Khan, the government may arrest and send me to jail," said the Samajwadi chief.
According to the outgoing Chief Minister, both parties agreed on and finalised Khan for the role from the five nominees under consideration.
The SP leader had recently recovered from Covid-19 and was discharged from the hospital last week after being on oxygen support for several days.
