Minor’s rape accused acquittal due to typo reversed by Madras HC

The woman's advocate submitted that when the woman's statement was taken, the word "semen" in English was typed as "semman" in Tamil. The defence counsel took advantage of this error and argued that the child's mother had said that the child's undergarment had "semman" or "red soil".

The report which was finalised after taking opinion and inputs from the general public has said that a majority of people were opposed to the NEET examination and were of the opinion that this is creating an educational divide among the Urban elite students and those from the rural backgrounds.

The Bench’s remarks

All constitutional institutions are amenable to the jurisdiction of the Constitutional Court in its writ jurisdiction unless expressly barred or restricted by the Constitution itself. A Constitutional Writ Court has both jurisdiction and power to pass any judicial order against or in respect of any constitutional institution and particularly so in a public interest litigation.
