Opposing the reference to a five-judge constitution bench, senior advocate Abhishek Manu Singhvi told the bench that the issue involved was a short one and the same can be decided by a three-judge bench.
Declining to stay the operation of the ordinance promulgated on May 19 to overcome its May 11 judgment, the apex court posted for hearing on July 17, the Kejriwal government’s plea against the sacking of the 437 people who were engaged by the Delhi government.
Describing it unconstitutional, the Delhi government in its petition has said that the ordinance takes away the power from an elected government and vests it in an unelected Lieutenant Governor – a Centre’s appointee.
