A bench of Justices Hrishikesh Roy and SVN Bhatti posted the matter for hearing on Monday, after advocate appearing for Rajeev Babbar said a copy of the petition was served on them late in the evening on Thursday and sought time to respond to it.
A magistrate court in Mumbai also suspended the sentence of the firebrand Shiv Sena leader to allow him to file an appeal.
The court also slapped a fine of Rs 25,000 on Mr Raut in the case.
“Issue notice, returnable in four weeks. Further proceedings in pursuance to the impugned judgment is stayed until further orders,” the bench ordered.
The reply document stated that subsequent to his conviction, the Congress leader, in a press conference, said that he would never apologise "as he was not a Savarkar but a Gandhi".
MV Govindan had made false allegations against K Sudhakaran in connection with a POCSO case in which a self-styled antique dealer Monson Mavunkal was sentenced to life term recently.
The Supreme Court on Tuesday had agreed to hear Gandhi's plea on July 21 after senior advocate Abhishek Manu Singhvi, appearing for Gandhi, sought urgent listing of the matter.
In March, the magisterial court had convicted Gandhi for his remarks on ‘Modi’ surname that he had made during a public gathering before the 2019 General Elections to the Lok Sabha.
