Granting bail to Kumar, a bench of Justice Surya Kant and Justice Ujjal Bhuyan noted that he is in custody for 100 days and chargesheet has already been filed in the case.
The Delhi Police had opposed Kumar’s bail plea, saying that releasing him on bail could influence the probe.
The high court had dismissed Bibhav Kumar’s bail plea, stating that no ground to grant him the relief was made out as he enjoys “considerable influence” and it cannot be ruled out that the witnesses may be influenced or evidence tampered if he is released on bail.
According to sources, the 1,000-page chargesheet includes statements recorded by the RS MP before the magistrate, along with statements of about 50 witnesses.
Rajya Sabha MP and former DCW chief Swati Maliwal on Tuesday wrote to top leaders of the INDIA bloc, including Congress leader Rahul Gandhi and NCP(SP) chief Sharad Pawar, seeking their time to discuss the alleged assault on her by AAP supremo Arvind Kejriwal’s close aide.
Kumar has also sought appropriate compensation for his illegal arrest.
This comes a day before Kejriwal's close aide's four-day judicial custody ends.
Bibhav Kumar, the aide of the Delhi chief minister, was arrested on May 18 in connection with the alleged assault on Maliwal on May 13.
Kumar was produced before the magisterial court here upon the expiry of his five days custodial remand in the Delhi Police custody. He will now remain in judicial custody till May 28.
