SC made observations during the hearing on a batch of pleas seeking a collegium-like system for the appointment of the ECs and CEC.
Justice Joseph specifically questioned the AG on the criteria adopted by the Law Minister in picking four names from the DoPT's database.
The apex court told the Centre that it wanted to understand the process that was followed in the appointment of the former bureaucrat as Election Commissioner even as it was hearing a case regarding the procedure for such appointments.
A five-judge Constitution bench headed by Justice K.M. Joseph said: "We need a CEC who can even take action against a PM."
