The Supreme Court said this while reserving orders on pleas challenging the Allahabad High Court judgement declaring the 2004 Uttar Pradesh Board of Madrasa Education Act as unconstitutional.
The petitioner had moved the withdrawal application on Wednesday and the court was slated to give its verdict on Thursday.
Both the parties are accusing each other of being sympathisers of the candidates.
The accused was awarded the sentence by the MP MLA Court of Ghazipur under the Gangster Act in the BJP MLA Krishnanand Rai murder case.

The permission was granted by the court subject to payment of Rs 10,000 in the Legal Services Committee, Allahabad. The amount must be deposited on or before the next date of listing, which is fixed as October 31, the High Court added.
The appeal filed by seven devotees sought direction from the Archeological Survey of India (ASI) to ascertain the nature of the structure found on the Gyanvapi campus.
Earlier on September 29, the court had reserved the order in the Gyanvapi Mosque-Shringar Gauri case after hearing both sides' arguments.
