The Supreme Court said this while reserving orders on pleas challenging the Allahabad High Court judgement declaring the 2004 Uttar Pradesh Board of Madrasa Education Act as unconstitutional.
The petitioner had moved the withdrawal application on Wednesday and the court was slated to give its verdict on Thursday.
Both the parties are accusing each other of being sympathisers of the candidates.
The accused was awarded the sentence by the MP MLA Court of Ghazipur under the Gangster Act in the BJP MLA Krishnanand Rai murder case.
Justice Mayank Kumar Jain has now fixed June 4 for hearing him through video conferencing.
The court also stayed the 7-year imprisonment given by a trial court in the case.
The court ordered the state government to enroll the students studying in the madrassas in other schools.
In the petition, the order given by the MP-MLA Court of Pratapgarh on March 17, 2023 was challenged where the state government's application to withdraw the case against them was rejected.
A bench of Chief Justice D Y Chandrachud, Justice J B Pardiwala and Justice Manoj Misra said it will tag the appeal against the High Court order along with the main case pending before the court.
