In a major victory for Aam Aadmi Party (AAP), the Supreme Court on Friday said that the 10 nominated members of Delhi Municipal Corporation also known as aldermen will not vote in the election of the mayor, deputy mayor and the members of the Standing Committee.

The top court order is being seen as a jolt to Lt. Governor who had nominated the 10 members and it was being insisted that they will vote during the election of mayor, deputy mayor and the members of the Standing Committee.

Referring to the provisions of the constitution and that of the Delhi Municipal Corporation Act, Chief Justice D Y Chandrachud heading a bench also including Justice P S Narasimha and Justice J B Pardiwala said that soon after the election of mayor, which in the instant case will be AAP mayoral candidate Shelly Oberoi, she would preside over the meeting of the House and conduct the proceedings for the election of Deputy Mayor and the members of the Standing Committee.

Noting that the election to the Delhi Municipal Corporation had taken place in December last year and the election of the Mayor and other bodies have not taken place yet,  the court ordered that a notice for the convening  of the first meeting of the elected members of the civic body will be issued in 24 hours which also specify the date of meeting in which election of the Mayor, deputy Mayor and members of standing committee will take place.

Brushing aside the argument that the 10 members nominated by the Lt. Governor are entitled to vote in the first meeting and not the subsequent meetings, the court said that there was no distinction between the first meeting of the MCD House and the subsequent ones and aldermen are not entitled to vote in any one of them.
