The Odisha government does not have the list of political prisoners arrested under Maintenance of Internal Security Act (MISA) during the enforcement of emergencies in the seventies.
Besides, the government does not have any scheme or provision to provide financial assistance to the political prisoners of Emergency unlike freedom fighters, the state Finance Department informed Orissa High Court in an affidavit.
Responding to the government’s replies, the high court quashed the public interest litigation (PIL) seeking provision for financial assistance along with free healthcare for the political prisoners arrested and jailed under MISA during Emergency from 1975 to 1977.
A division bench of Chief Justice S Muralidhar and Justice M S Raman said, “If in fact there is no scheme of assistance, the court cannot issue a direction in this regard.”
