Petition filed against BJP spokesperson for ‘bad-mouthing’ Sonia, Rahul

A petition has been filed here in the court of Chief Judicial Magistrate against BJP national spokesperson Anil Baloni for making ‘false allegations’ and ‘derogatory remarks’ against Congress president Sonia Gandhi and vice president Rahul Gandhi during a debate on a TV News Channel.

The channel head has also been named in the petition.

The petitioner Rikin Ahluwalia, who is a Congress leader, said that the charges were framed under Indian Penal Code (IPC) sections 294, 504 and 505 via petition no 7905/17 filed in the court of Chief Judicial Magistrate on Friday.

The IPC Sections 294,504 and 505 are for using obscene words, intentional insult with intend to provoke breach of peace and statements conducing to public mischief.

Ahluwalia is associated with the Facebook page of Congress and is a former Sewa Dal district president.

Raising strong objections against the ‘derogatory remarks’, Ahluwalia decided to file a petition, considering it an attempt to malign the image of their top party leaders.

“It was a prerecorded debate which was later telecast and not a live show, hence the channel head too has been made a party,” said Ahluwalia and added that had the Channel wanted they would have removed the objectionable portion.

On the issue of ‘derogatory remarks’, Congress spokesperson Hari Krishan Verma said that such statements are being made for vested political gains and we are left with no other option but to take a legal course.

“BJP is trying to mislead the youth by making such statements against the Gandhi family, whose contribution in building up the nation could not be declined, ” he said.

Anil Baloni is a BJP leader from Uttarakhand who is considered to be close to Amit Shah. Baloni was made national spokesperson of the BJP by Shah, shortly after he took over as National President of the party, reportedly overlooking many other senior leaders from Uttarakhand.
