Breach of Privilege: MLA again moves notice against female IPS officer

Aggrieved with Haryana Assembly Speaker's decision to disallow a Breach of Privilege notice moved by Congress legislator Jai Teerath Dahiya seeking action against female Indian Police Service (IPS) officer Bharti Arora, over the issue of "defamation", the legislator on Wednesday asked Speaker Kanwarpal Gurjar for re-consideration of Privilege notice, failing which, he would knock the door of the Punjab and Haryana High Court.

Speaking to The Statesman, Dahiya said he had moved the Privilege notice but the Speaker disposed of the notice without forwarding it to Committee on Privilege. "But I am not satisfied with the decision. Hence today, I against moved the notice for re-consideration. In case, the Vidhan Sabha Speaker does not treat it as Privilege notice, I will move the High Court," he said

In his notice for re-consideration, Dahiya has submitted that Speaker's order was merely advisory in nature rather to go into the real facts of the matter.

Dahiya has also requested the Speaker to reconsider the matter and refer the same to the Committee on Privileges so that the allegations made by Arora, Principal-cum-Director of Motilal Nehru School of Sports (MNSS), Rai, be examined by the Committee thoroughly and facts finding report be submitted in of the matter.

The spat between the two started when Dahiya publically raised the issue relating to some alleged irregularities at MNSS. For which, Arora served him a legal notice for allegedly defaming her image through his statements in the media.

In the legal notice, Arora, also threatened to sue Dahiya for Rs Four Crore and start criminal proceedings in case the Congress leader does not tender apology in a week.

However, Dahiya moved Vidhan Sabha with Breach of Privilege Notice against Arora under Rules 280-281-297 of Procedure and Conduct of Business of the State Legislative Assembly.

Following which, the Assembly Speaker issued how cause notice seeking explanation from the IPS officer while in her reply to the Assembly Speaker, Arora termed the statements of Dahiya in media as personal attack on her and defamatory but her legal notice does not even intend to violate the privilege of the House.

Although, Speaker Gurjar disposed of the notice of Dahiya without taking any action. Following which, Dahiya again moved the notice.

Arora also hit headlines when an audit of the MNSS, conducted by the Haryana Finance Department from 1 April, 2015, to 1 January, 2017, reportedly found gross irregularities during her tenure as director of the school.

The audit report says that there were embezzlement, fraudulent payments and misappropriation of funds in the purchase of sports material, furniture and other items in the school.
