Odisha man fined by HC for filing frivolous petition

The Orissa High Court dismissed a frivolous criminal miscellaneous petition and slapped Rs 25,000 fine on the petitioner by describing him as a meddlesome interloper who deliberately tried to consume the time of court with a vested interest.

Slapping the fine on the petitioner Samarjit Mohanty, Justice Dr. S K Panigrahi in an order pronounced recently said he has stopped the court from delivering justice to legitimate petitioners whose rights have actually been violated.

The petitioner had prayed for a direction from the high court with regard to initiation of legal action against the teachers who reportedly got jobs by producing fake certificates. However, the court was informed by the Vigilance Department that action has been taken by the Superintendent of Police, Vigilance, Berhampur in this regard.

“The petitioner is masquerading himself to be a social worker and is unnecessarily interfering with the reputation of the genuine candidates. Further, he is in no way connected to the present case except for blackmailing purpose,” the single bench of HC, Justice Panigrahi stated in the order.

The Supreme Court of India had articulated that any attempt to misuse the legal system by the litigant must be negatively seen by the court and in order to deter others from doing the same exemplary cost must be imposed, the order said citing the apex court ruling.

“The petitioner is imposed a cost of Rs 25,000 as a deterrent measure to discourage such frivolous petition and not to repeat such type of misadventure in future. The said cost shall be deposited before the Orissa High Court Bar Association Welfare Fund within two weeks and the receipt thereof shall be filed before this Court”, the order concluded.
