Legal Notice issued against United Opposition Forum in Assam over anticipated CAA protests

In anticipation of disturbances over implementation of CAA in Assam, the government has issued a legal notice under section 152 of the Crpc, 1973, directed towards the United Opposition Forum in the state regarding their collective opposition to the Citizenship Amendment Act (CAA).

According to the notice issued by the Deputy Commissioner of Police, released by the “United Opposition Forum”, both the individuals and the organisation have called for a “Sarbatmak Hartal” in Assam on March 12 from 6 AM to 6 PM.

The notice expresses concern that such a “Sarbatmak Hartal” (total lockdown) may lead to disturbances of peace and security, potentially disrupting the daily lives of peaceful citizens in the state.

Anticipated consequences include road blockades, forced closure of businesses, and damage to public and private property, including railways and highways, thus hindering the delivery of essential services.

The notice deems these protests as illegal and unconstitutional, citing judgments from various courts, including by the Gauhati High Court.

It warns of legal repercussions against both individuals and organisations involved in the protest if they fail to withdraw their plans to maintain peace in the state.

It specifically mentions that the blockade of highways and railway tracks, as proposed in the “Sarbatmak Hartal,” has been declared illegal and unconstitutional by multiple courts. Reference is made to a specific order passed by the Gauhati High Court on March 19, 2019, in Writ Petition (C) 7570/2013.

The notice instructs the recipients to retract their call for the “Sarbatmak Hartal” and cooperate in preserving peace in the state.

Failure to comply may result in legal action under relevant provisions of the law, including the Indian Penal Code and the Prevention of Damage to Public Property Act, 1984.

It further warns that if any damage occurs to public or private property or if any citizen is injured due to the “Sarbatmak Hartal,” the individuals and the organisation will be held accountable, and the total cost of damage will be recovered from them.
