Jaypee Associates on Wednesday deposited the first installment of Rs.275 crore as the Supreme Court fixed January 10, 2018 as the next date of hearing in the matter.
The apex court also made it clear that the promoters and independent Directors of Jaypee cannot sell any property belonging to them and also their family members, without prior court permission.
Cautioning the directors, the SC said alienation of property would make them liable for criminal prosecution as it asked them to appear before the court again on January 10.
The payment is part of the Rs.2000 crore that Jaypee has been asked to protect the interest of the home buyers of Jaypee Infratech — it’s wholly owned company — which is under restructuring on the orders of the Allahabad bench of the NCLT.
The IDBI had moved the National Company Law Tribunal (NCLT) for default of payment against the loan taken by it.
The second installment of Rs.150 crore will be deposited by December 14 and the third tranche of Rs.125 crore by December end, reports said.
A bench of Chief Justice Dipak Misra, Justice AM Khanwilkar and Justice DY Chandrachud had on November 6 asked the real estate major to deposit the amount as it refused to permit it to deposit a part amount of Rs.400 crore by November 10.
Jaypee Associates has earlier informed the court that it would submit Rs.400 crore every month starting with January.
