And to address this complex topic, Raj Kumar Nahataa, founder of “JMRK Legal Associates,” on Thursday announced the launch of his book, “Comprehensive Guide on Benami Law.”
The book is a thorough reference that, as its name implies, reflects the complexity of Benami Law and Indian jurisprudence. It will be sold on LexisNexis.
This book will thoroughly examine and critically analyse every aspect of benami transactions. The book explores the beginnings, development, and history of the Benami Statute and presents a fair picture by incorporating arguments from both sides drawn from rulings by the Privy Council and other courts. Additionally, it discusses the issues raised by benami transactions, the level of court acceptance of such transactions, and the extent of English law’s effect.
At the book launch, Nahataa said that it provides an in-depth analysis of the Supreme Court’s judgement dated August 23, 2022 in Union of India & Anr v. Ganpati Dealcom Pvt. Ltd. [Special leave petition (Civil) No. 2784/2020], which holds great relevance in the present times, especially considering the fact that a review has already been filed against the said August ruling and is likely to be heard by the Apex Court soon.
The book concludes by systematically highlighting the issues that still remain unanswered and providing certain recommendations on the benami law in India. The book launched on January 19, 2023, and is now available in offline and online stores.
