Retired Justice of Calcutta High Court Rabindranath Samanta joined the West Bengal Real Estate Appellate Tribunal as its chairperson on Wednesday.
Eight years after the 2016 act came into force, the chairperson of the tribunal has been appointed, official sources said.
The West Bengal Real Estate Appellate Tribunal has been established under Real Estate (Regulation and Development) Act, 2016 enacted by the central government. After the Act came into force, West Bengal government enacted a similar Act, namely the Housing Industry Regulation Act, 2017.
But this Act was struck down as unconstitutional by the Supreme Court on 4 May, 2021 in the case of Forum for Peoples Collective Efforts vs State of West Bengal.
Soon, West Bengal Real Estate Appellate Tribunal was established.
The object of the Act is to regulate and promote the real estate sector and to ensure sale of plot, apartment or building in an efficient and transparent manner and to protect the interest of consumers.
